Minutes of the Richfield City Planning Commission meeting held on Tuesday, July 2, 2019, at 6:00 p.m., Chairman Monte Turner, presiding.
1. Roll Call.

1. Roll Call. Roll call was answered by Brion Terry, Monte Turner, Greg Bean, Kendrick Thomas, Susan Jensen, and Blaine Breinholt. Lisa White was excused.
City Staff Present: Deputy City Recorder Michelle Curtis and Building Official Rick
Robinson.
Others present: Jaden Greenhalgh, Mr. and Mrs. Brent Jensen, Mark Blake.
Rick Robinson was introduced as the recently hired Building Official (building inspector, zoning administrator).
2. Public Hearing (6:01 p.m.): Receive comments concerning a proposed amendment to the General Plan and Zoning Map affecting property located at 160 East Center Street. The purpose of the hearing is to clarify that the property, formerly occupied by Valley Builders, is in the D zone (Downtown) rather than the RM-11 zone (multi-family residential). Brent Jensen was present. He is the owner of the property. The property sits on the border of the RM-11 and D zones. The zoning map shows the property as being located in the RM-11 zone. However, Valley Builders Supply was housed at this location for many decades posing the question as to whether the zoning map was drawn incorrectly and this property was in the D zone. Mr. Jensen said they are now selling the property and they would like to sell it as commercial (D zone) property.
The public hearing closed at 6:03 p.m.
3. Zone Clarification: Discussion and recommendation to City Council determining the zone of the property located at 160 East Center Street (RM-11 vs. D zone). Because of the many years that Valley Builders was located at this address, the Planning Commission feels it is likely that the zoning map was drawn incorrectly and the property is located in the D zone (Downtown).
Brion Terry motioned to recommend to the City Council that it is clarified that the property located at 160 East Center Street is in the D zone (Downtown), and the zoning map being updated accordingly. Blaine Breinholt seconded the motion. Those voting aye: Brion Terry, Monte Turner, Greg Bean, Kendrick Thomas, Susan Jensen, and Blaine Breinholt. Those voting nay: None. The motion carried unanimously.
4. Conditional Use/Home Occupation Permits:

B. Consider approving a Conditional Use Permit allowing Jaden Greenhalgh to conduct an automotive detailing business called Greeny’s Auto at his home at 596 Ogden Drive (R1-10 zone, C1 use). Jaden Greenhalgh was present. He works full-time at the Gunnison prison. Because he works the 12-hour night-shift schedule, he has time off and could do a part-time job. He has about eight days a month when he is off and could do this. He will detail cars during the week, during the day, and rarely on weekends.
Mr. Greenhalgh has a deep, two-car garage where he can work cars. The initial washing will be outside of the garage. Detailing a car means shampooing carpets, cleaning the inside, washing the paint, polish, and wax. There will be a vacuum and shampooer. The noise level is probably similar to a shop vac with the shampooer being a little louder with a water pump. Once in a while he will use an electric pressure washer which is quieter than a gas one.
As far as run-off water, there is gravel all around the house. He will park the cars in the gravel for washing, so he believes the run-off water will stay in the gravel. He will not use chemicals on it. A high pressure washer uses less water than a hose.
His driveway is on the east side of his home and is next to the neighbor’s driveway and garage which creates a buffer. He is insulating his garage and believes that will kill a lot of the noise.
Mr. Greenhalgh does not plan to have employees. There will only be one client there at a time. It will take 4 to 6 hours to detail a car, so he will only do one car a day. He has a large area of gravel and he can easily park his own car towards the back of the home. He will not have to have any cars parked on the street or in the driveway.
Mr. Greenhalgh agrees to the conditions as listed on the Home Occupation Permit application with the addition that the operation of power equipment will be limited to hours between 9 a.m. and 7 p.m. and having only one customer at a time
Kendrick Thomas said his biggest concern would be the washing of the vehicles outside. That could bother neighbors or the water potentially discharge into the gutters out onto the street. Mr. Greenhalgh was advised that the City wouldn’t want water going into the public street. He will need to make sure it is contained on his property and that the area where the washings happen stays well maintained. Mr. Greenhalgh said his property slopes in such a way that it should go towards his back yard.
Greg Bean motioned to approve the Conditional Use Permit allowing Jaden Greenhalgh to conduct an automotive detailing business called Greeny’s Auto at his home at 596 Ogden Drive (R1-10 zone, C1 use). Susan Jensen seconded the motion. Those voting aye: Brion Terry, Monte Turner, Greg Bean, Kendrick Thomas, Susan Jensen, and Blaine Breinholt. Those voting nay: None. The motion carried unanimously.

They would like to construct a fence that is 7-1/2 feet tall. They will have a retaining wall of 18 inches with a 6-foot tall wood fence. This will be on their back property line.

Rick Robinson advised Mrs. Baker that this will require a building permit and a designed retaining wall.
Blaine Breinholt motioned to approve the application for a fence and retaining wall to be 7-1/2 tall with the designed retaining wall approved by the building inspector. Kendrick Thomas seconded the motion. The motion carried.
6. Other Business.
A. Billboard Discussion: Mark Blake was present to discuss the possibility of changing the Zoning Code so that billboards and billboard advertising can be allowed in the City. He would like to advertise his mortgage company on a billboard. The Reagan signs are cost prohibitive at $1100 per month. He wondered if he could erect a new billboard at the vacant lot at 1100 South Hwy 89. The lot is owned by Jerry Larsen and he has told Mr. Blake he would agree to this. Section 2020 of the Zoning Code states that off-premise signs, including billboards, are not allowed. There are a few billboards around the City, but they are legal non-conforming uses. Mr. Blake has talked with a few other business owners who would like the ability to use this advertising.

He does understand that the City doesn’t want the street littered with a lot of signs. He would like to advertise his business and thought perhaps he could construct a billboard with two sides so that there would be room for two businesses to advertise on each side of the sign. He has talked with Sign Central and knows that a billboard sign would have to be engineered with steel poles.
It was suggested that the Commission could do some research and see what other cities are doing. A change in the Zoning code would require a public hearing with a recommendation made to the City Council. The City Council would also have to have a public hearing. He was also advised that because the proposed property is along a UDOT right-of-way, he should check with UDOT to see what they will allow.
He was advised that it will take some time on the part of the Commission to research. Before going forward, Mr. Blake will contact UDOT to see what they will allow. Depending on what he finds out there, he will go to City Council to get a feel from them as to whether they are open to the idea of allowing billboards within the City. Mr. Blake will contact staff if wants the Commission to move forward.
B. Animal Ordinance: Discuss to whether or not consideration should be given to allowing pet pot-bellied pigs in the City. A request has come in for the City Council to revise the Municipal Code so that pot-bellied pigs can be allowed. Reading from a site called ‘The Pet Place’ it says that “pigs are not very good pets if left home alone with no mental stimulation or physical challenges. Because of their intelligence, they can be very aggressive with young children. Pot-bellied pigs average about 125 pounds.” The Commission discussed this, and they are not in favor of changing the ordinance to allow pet pot-bellied pigs. If there are four or five requests over time, then it could be looked at again.
Rick Robinson said he could write a letter advising that it is against the ordinance. He will need to work with Michele Jolley on this because it will be on the City Council agenda.
