Minutes of the Richfield City Planning Commission meeting held on Wednesday, June 6, 2018, at 6:00 p.m., Chairman Brion Terry, presiding.

Ideal Acres: A public hearing was opened to receive comments concerning a preliminary subdivision application filed by Garth (Tooter) Ogden/Ideal Acres regarding property located at approximately 800 North 700 East.) A copy of the preliminary subdivision plat is displayed on the screen. There being no public comments, the hearing closed at 6:01 p.m.

A. Little Learners Preschool: Consider approving Rebecca Barney’s application for Little Learners Preschool to be located at her home at 345 South 300 West. (R1-10 zone, C-1 Use.) Mrs. Barney and her sister-in-law, JaLee Alger, have been operating this pre-school at Mrs. Alger’s home. Mrs. Alger has sold her home and so Mrs. Barney will be operating the pre-school at her home which is just north of the original location. The clientele will be the same. The parking and picking up of children will not change as this home is on the same side of the street.

Those voting aye: Brion Terry, Susan Jensen, Lisa White, David Mower, Monte Turner, Blaine Breinholt, and Greg Bean. Those voting nay: None. The motion carried unanimously.
B. The Kids Cabin Preschool: Consider approving Jessica Clark’s application for The Kids Cabin Preschool to be located at 230 West 700 South. (R1-10 zone, C-1 Use.) Jessica Clark and Marsha Barney were present. Mrs. Clark would like to open a preschool. She currently rents a small home and so her mother, Marsha Barney, has given her permission to use the basement of her home as a preschool. Mrs. Barney’s home is located at 230 West 700 South. In the past, Mrs. Barney operated a daycare in her home and so the basement is already set up and ready for this type of use. The home has a large yard that is fenced.
There will be no employees. Mrs. Clark plans to do a morning and afternoon session. She won’t have more than ten kids per session. She plans to hold recess at the end of the session so that they will be outside and she can watch as children get picked up.
Greg Bean motioned to approve Jessica Clark’s application for The Kids Cabin Preschool to be located at 230 West 700 South. (R1-10 zone, C- Use.) Monte Turner seconded the motion. Those voting aye: Brion Terry, Susan Jensen, Lisa White, David Mower, Monte Turner, Blaine Breinholt, and Greg Bean. Those voting nay: None. The motion carried unanimously.

Derrick Barnson and Carson Peterson represented Weber Auto Sales. Susan Jensen stated that she has a personal connection with Derrick Barnson as he is her mother-in-law’s step-grandson.

Derrick Barnson and Carson Peterson represented Weber Auto Sales. Susan Jensen stated that she has a personal connection with Derrick Barnson as he is her mother-in-law’s step-grandson.
Mr. Peterson is the owner of Weber Auto Sales. This will be his fifth car lot in the State. Mr. Barnson will manage the business. The car lot will be located at the former Jones Paint & Glass building on Main Street. In the past, Larry Jones operated a car sales lot at this location. There is a smaller shack on the property which was used by Mr. Jones as the office for the auto sales. They won’t be using the shack and might even move it.
Chairman Terry said he did some research on the property. In reading the City Council minutes in 2010 and 2011, Mr. Jones was issued a Conditional Use Permit allowing him to have four cars for sale and also requesting a little bit of landscaping, xeriscape, under the pole sign. The landscaping was never done. They were limited to four cars at the very north part of the property because the building was still being used as a furniture and carpet sales.
This car lot will be used for sales and no repairs. They are hoping to display 20 cars for sale on the property. They plan to use parking along 200 South for customer parking which would give them three or four spaces. The Commission is doubtful that 20 cars will fit there. Mr. Barnson said if 20 cars won’t fit, they won’t force it. There is a fence that goes north/south at the south side of the building. They plan to slat it so that it hides what is behind there. There will be one employee, possibly two employees.
David Mower motioned to grant the Conditional Use Permit allowing Weber Auto Sales to conduct an auto sales business at 22 East 200 South (D zone, C-1 use) with the condition of providing a lease agreement with a legal description showing what is being rented. They agree that the number of vehicles they park will be up to them as far as what fits. They are required to fix the trench on the south side, make it look nice, and clean up the weeds. The sign on the top of the building will be replaced. Blaine Breinholt seconded the motion. Those voting aye: Brion Terry, Susan Jensen, Lisa White, David Mower, Monte Turner, Blaine Breinholt, and Greg Bean. Those voting nay: None. The motion carried unanimously.
It was pointed out that a Conditional Use Permit can be reviewed if complaints are received or if any concerns arise.
