Minutes of the Richfield City Planning Commission meeting held on Wednesday, April 23, 2018, at 6:00 p.m., Chairman Brion Terry, presiding.

1. Roll Call.
2. Minutes Approval: Consider approving minutes of February 7, 2018.
3. Public Hearing: (6:00 p.m.)

    Receive comments concerning a proposed amendment to the General Plan

    and zoning Map. The subject property is located at 1955 South Cove View

    Road (the old Elk’s Lodge property), and is located in the CG zone

    (commercial general). The applicant is requesting that the zone be

    changed to the RM-11 zone (multi-family residential).
4. Rezone:

    Consider making a recommendation whether the City Council should

    approve or deny the application requesting a rezone of the property located

    at 1955 South Cove View Road (the old Elk’s Lodge property). Zone is

    proposed to be changed from CG (general commercial) to RM-11 (multi-

    family residential).
5. Other Business:

1. Roll Call. Roll call was answered by Brion Terry, Greg Bean, Monte Turner, Blaine Breinholt, and Susan Jensen. David Mower and Lisa White were excused.
 
City Staff Present: Deputy City Recorder Michelle Curtis.
 
Others present: Coylene Brinkerhoff, Kisten Meiners, and Annicka Albrecht.
 
2. Minutes Approval. The minutes of February 7, 2018, were reviewed. Greg Bean motioned to approve the minutes of February 7, 2018. Susan Jensen seconded the motion. Those voting aye: Brion Terry, Susan Jensen, Monte Turner, Blaine Breinholt, and Greg Bean. Those voting nay: None. The motion carried unanimously.
 
3. Public Hearing: (6:06 p.m.) Receive comments concerning a proposed amendment to the General Plan and Zoning Map. The subject property is located at 1955 South Cove View Road (the old Elk’s Lodge property), and is located in the CG zone (commercial general). The applicant is requesting that the zone be changed to the RM-11 zone (multi-family residential).

There were no public comments. The public hearing was closed at 6:07.

 
4. Rezone: Consider making a recommendation whether the City Council should approve or deny the application requesting a rezone of the property located at 1955 South Cove View Road (the old Elk’s Lodge property). Zone is proposed to be changed from CG (general commercial) to RM-11 (multi-family residential).  Coylene Brinkerhoff and Kisten Meiners were present. They have requested this zone change because they would like to purchase the old Elk’s Lodge and create a twin home. Some Commission members have heard comments from citizens voicing opposition to changing the zone to multi-family. The opposition is not against the Petitioners converting the building into a twin home, but rather by changing the zone, it opens up the entire property to multi-family units (apartments) and that causes concern for some.
 
Regarding the existing septic tank, the petitioners have talked with the County and they would have to have another septic system. There isn’t room for that, so they would be interested in hooking into the City’s sewer system. More than likely, they will want to hook onto City water as well.
 
Annika Albrecht lives near this property. She commented that she has spoken with several people and they don’t feel like it is a good idea to zone the property multi-family. It might be alright if there was a way to ensure that nice condos rather than apartments would be built here. It is noted that sometimes condos on a golf course are enticing to retired people.
 
The following options were discussed:
• Change the zone to RM-11 and have Restrictive Covenants or CC&Rs stating that apartments cannot be built on the

   property. It is noted that CC&Rs are not enforced by the City.
• Change the zone to RM-11 but record something saying they would never have apartments and if the property is

   ever sold, the buyer would have to come back to ask for a re-zone.
• Rezone the portion of property where the building sits to RM-11 (multi-family) and then leave the balance of the

  property in its current zone of CG (general commercial). That would require the property to be split because a

  property cannot be zoned as separate zones.
• Rezone the portion of the property where the building sits to RM-11(multi-family) and then rezone the balance of the

   property to R1-10 (single family).
• Rezone to R1-10 (single family residential) and treat this as a residence with an accessory dwelling. It appears this

  would fit the requirements for an accessory dwelling unit. The units would have to be treated as one and could not be

  separated to be sold separately. They would have to share utility connections.
   
It seems that the R1-10 zone is a good fit for this area. By allowing this building to be used as a primary residence with an accessory dwelling, which would allow the Brinkerhoffs to do what they are proposing.
Greg Bean motioned that it be recommended to the City Council that the property located at 1955 South Cove View Road (the old Elk’s Lodge property) be rezoned to R1-10, single family residential, which would allow an accessory dwelling. Monte Turner seconded the motion. Those voting aye: Brion Terry, Susan Jensen, Monte Turner, Blaine Breinholt, and Greg Bean. Those voting nay: None. The motion carried unanimously.

There had been a misunderstanding as to the time of the public hearing. At 7:00 p.m., the following residents arrived: Connie Jolley, Will Jolley, Selena Terry, Ray Terry, Kristi Whitaker, and Robert Whitaker. Chairman Terry explained to them the discussion that has taken place and that a motion was made which is a recommendation to the City Council that the property be rezoned to R-10 which is single family and allows an attached accessory dwelling. This would not allow apartments, and this building could not be split to be sold as separate properties.
